YRS Law Nestham Scheme Eligibility Criteria
The Eligible Caterpillars that have been issued under this scheme are –
- The lawyer must have a bachelor’s degree in law.
- To avail of the benefits of this scheme, the names of the lawyers should be entered in the list of lawyers maintained by the Andhra Pradesh State Bar Council under Section 17 of the Advocates Act, 1961.
- Applicants must be under 35 years of age.
- The applicant should have a permanent election in Andhra Pradesh.
- Beneficiaries who have passed 2016 and beyond will be eligible for this scheme.
- Lawyers should also be given a promise that they will inform the registering authority online or if they leave the job or take a job for a profit.
- Junior Advocates who have started the practice and have not completed the first three years of their practice will be eligible for a stipend under this scheme. Under section 22 of the Advocates Act 1961, the date of the first three years of practice will be calculated from the date of issue of the certificate of enrollment.
- Lawyers must pass the bar examination conducted by the Bar Council of India within two years after enrollment with the State Bar Association, and secure a certificate of practice.
- To avail of this scheme, Junior Advocates have to submit an affidavit attested by a Senior Advocate having 15 years of practice or a Court Presiding Offer or Test Bar Association that he still has active practice every 6 months.
- Advocates who have completed the first three years of the program will not be eligible for this scheme.
- Lawyers who have a four-wheeler in their name will not be eligible for this scheme.
- Advocates who have not practiced, that is, non-practicing advocates, will not be eligible to apply.
